What legal permissions are needed to build Wastewater Gardens® system? Subsurface flow wetlands have been reviewed and approved by the United States Environmental Protection Agency and by many European regulatory bodies. Regulatory guidelines differ markedly from country to country, and even within countries, local governing bodies have greater or lesser familiarity with constructed wetlands. In most areas, getting approval will not be difficult, but in some regions, education of local health department officials is required before permission to proceed is granted. In Poland the procedure to build constructed wetland must comply with building and environmental regulations. Small wastewater treatment plants with a capacity up to 5 m3 per 24 hours do not require a building license but only notification about the investment to the local authority. If there is no response within 30 days it means that building operation can start. According to environmental law, small wastewater treatment plants with a capacity up to 5 m3 per 24 hours does not require water supply and sewage effluent disposal consent since it is qualified as an ordinary water use. Before starting to use the system, investor must only submit the detailed information to the relevant local authority.
